1. General

Terms and Conditions govern the way in which James Hogg Display sells and markets its products to customers.

James Hogg Display does not sell products and services directly to consumers (as defined in the Consumer Rights Act 2015) If you are a consumer, you may not order from us directly.

James Hogg Display provides an excellent product and service and it is our wish that all customers read and understand the following guidelines.

James Hogg Display is a fully integrated eCommerce website providing a variety of indoor & outdoor products for the Events and Exhibitions industry as well as retail and end-user products.

By using this website (James Hogg Display) you agree to be bound by these terms and conditions. Should you not agree to be bound by these terms you must not use this website for any purpose.

Your statutory rights are not affected by these terms and conditions, however, we reserve the right to refuse to supply goods or services at our discretion and without further explanation.

2. Offer and Acceptance

Once you “the Customer” have received confirmation of your order via either

Telephone, e-mail or by other means a legally binding contract has been created between you and James Hogg Display.

Important notice – Any products that are bought, regardless of their point of purchase and origin, the contract is between you “the Customer and James Hogg Display.

3. Delivery

James Hogg Display uses third party couriers to arrange and carry out deliveries and collections. James Hogg Display does not accept the responsibility, and will not offer any compensation, for any loss of profits caused due to the late delivery of any items by the courier. This includes, but is not exclusive of, a project being delayed, miss organised installation time or date or any other inconvenience caused to the customer. James Hogg Display will share any relevant contact information including, but not limited to, name. phone number, email address, geographical address with the third party courier we use for delivery of goods.

James Hogg Display deliver all orders in plain protective packaging. The return address noted on all recorded delivery will read:

Orders received at weekends and bank holidays are despatched next working day.

Express next-day delivery on all orders under £65.00 will be charged at £6.85 each. Orders placed on Friday will be despatched next working day.

Orders are processed immediately and dispatched within 1 – 84 working days.

All Royal Mail UK Mainland recorded deliveries not delivered will be held for 7 days at the specified local sorting office.

All returned orders will carry a re-delivery charge.

Certain products will require individual delivery charges due to size and weight and will be advised at point of purchase.

James Hogg Display will contact the individual customer, using contact details provided, with any queries concerning their order via email in the first instance.

Any UK ordered delivery which is more than 28 working days overdue you are requested to contact info@jameshoggdisplay.com

International orders are dispatched using a global courier network and priced at point of purchase.

Contact info@jameshoggdisplay.com to ensure your international destination is covered by our global courier network.

Delivery to all European destinations takes 7 to 10 working days. It is advised to opt for Express delivery to ensure you can track your parcel. We will not guarantee delivery of any mailed parcels once they are circulated within the specified country’s postal service.

Express delivery to European destinations will take 3 to 5 working days.

Express delivery to Worldwide destinations will take 7 to 10 working days.

The estimated delivery times do not allow for Weekend or Public Holidays.

Upon delivery of any items the products must be fully checked and tested before being signed for. In cases where this is not possible the customer must sign for as “unchecked”. If there is any damage to the packaging the customer must sign for as “damaged”. All goods must be checked and tested to ensure they are in full working condition within 24 hours of receiving the goods with no exceptions. If there are any problems this must be reported to James Hogg Display within 24 hours of receiving the goods. If this procedure is not followed James Hogg Display are unable to claim compensation from the courier and will therefore not pay out on, or replace, damaged goods. Please ensure that the individual/company who will be taking delivery of the goods is aware of this procedure and share this information with their internal teams.

Payment

Purchases can be made using credit and debit cards, or by BACS. All invoices are on a Pro-forma basis whereby clear funds are required on all orders prior to despatch

Company trading accounts are available subject to status relevant credit check and approval by James Hogg Display.

All online purchases through our checkout are presented to our merchant bank for verification and authorization. 

To assist in protecting customers from credit card fraud, a secure checkout for the encrypted delivery of sensitive customer information such as contact and credit/debit card details.

James Hogg Display does not store credit card details.

All personal details will not be passed to any third party.

Pricing

All prices are clearly displayed relevant to their product categories.

All prices are exclusive of but subject to VAT at 20.0%

All prices are reviewed daily.

Following any discrepancy in our list price, all customers will be notified of any error prior to despatch of goods. At this point, all goods and services can be purchased and charged at the prevailing rate or the option to cancel the order.

Prices are shown in and transacted in pounds sterling.

Global purchases using credit/debit cards registered overseas may well be charged at the local rate.

Return/cancellation of orders as governed by UK law (UK customers only).

James Hogg Display trade in accordance with recent EU directives for online and internet trading.

IMPORTANT NOTICE – The product(s) must be unused. The product(s) must be in its original condition and in the box or packaging in which it was supplied to the customer. We will not accept the return of product(s) that we are unable to re-sell. Additionally, we will not refund or replace the product(s) where the sealed packaging has been removed or the seal is broken. We must receive the product within 14 days from the order being completed.

We do not refund postage and packaging.

Returned product(s) that are not defective will be subject to a £5.00 handling charge. This will be deducted from your refund. If the product is not defective and you would like it posted by return, in addition to the £5.00 handling charge, postage will be also charged again at the original postal charge.

All free products given to all customers at the time of purchase must be returned. Non returned free item(s) will be deducted from your refund at the recommended retail price.

It is advised to keep proof of posting for all postal returns.

Personalised goods or made to order goods are excluded.

To cancel any order customers are requested to e-mail or write to James Hogg Display, Corby Enterprise Centre, London Road, Priors Hall, Corby, Northamptonshire, NN17 5EU, United Kingdom clearly marking the delivery “RETURNS” within seven days of delivery of your items, quoting your order number. Customers will be given a return number that must be used when returning your goods.
License Subscriptions
If you have opted in to our cloud-based license subscription service after purchasing digital hardware from us, then the subscription will continue in force for the agreed term as set out below, after which time it will expire.
Our license fees are chargeable as follows:-
1 Year £75.00 per screen per year + vat 
3 Year £180.00 per screen + vat
Lifetime £360.00 per screen + vat (Hardware Lifetime only)*
If a CMS license is purchased with a product this is not transferable to any other products. If a product with a valid CMS license suffers a hardware failure during its warranty period and a replacement product is required then James Hogg Display will transfer the CMS license in this case.
Except in the case of lifetime subscriptions, if you fail to renew and pay for a new subscription after it expires, then we will disconnect your screen(s) from the server and charge a reconnection fee of £250.00 + vat per screen, in addition to the subscription fee.
You are responsible for all content you upload onto our content management software. We use a third party portal, which you will have access to. Use of this portal is subject to the third party's terms and conditions and we cannot be responsible for any action or inaction of this third party.
" A Lifetime License is categorised as the lifetime of the hardware and not location based. If the hardware fails outside of the warranty period any license associated with the specific hardware is non transferrable to a new or replacement device.

Data Protection

Individuals may download content for personal, non-commercial use. The content may not be otherwise copied and may not be modified without the prior written consent of the copyright holder.

All reasonable efforts have been taken to ensure that the content is accurate and up-to-date, JMH Enterprises will not be held liable for any delays, inaccuracies or omissions it may contain.

Limitation of Liability

Nothing in this Agreement shall affect the statutory rights of any customer or exclude or restrict any liability for death or personal injury arising from negligence or fraud of JMH Enterprises.

Subject to the above clause, you agree that JMH Enterprises shall not be liable either in contract, tort, negligence, statutory duty or otherwise, for any:

1.1 Loss of profits, revenue or goodwill, damage for the loss of business, loss of sales, non payment of sums due, business interruption, loss of reputation, or any other pecuniary loss (even where JMH Enterprises has been advised of the possibility of such loss) or any type of consequential, indirect special loss or damage whatever arising from or in any way connected with this agreement

1.2 Delay, loss or damage (including loss or damage which is reasonably foreseeable or occurs naturally in the course of things) resulting from any acts, omissions, failures or delays occurring on or in relation to those parts of the internet not under JMH Enterprises direct control including, without limitation, internet service provider failure, industrial action, civil unrest, fire, flood, storm, earthquake, pandemic, act of terrorism or war, governmental action or any other action beyond our reasonable control, damage for the loss of business, loss of sales, non payment of sims due, loss of profits, business interruption, loss of reputation, loss of business information, or any other pecuniary loss (even where JMH Enterprises has been advised of the possibility of such loss or damage).

1.3 You also agree that (except in relation to such liability as has been expressly excluded in clause 1.1 above) the maximum aggregate of liability of JMH Enterprises in contract, tort, negligence, statutory duty or otherwise (even where JMH Enterprises been advised of the possibility of such loss or damage), for any loss or damage whatever arising from or in any way connected with:

1.3.1 Any defect in a product

1.3.2 Any failure by JMH Enterprises to process signals, data, information, orders or messages correctly, or in a timely manner.

1.3.3 Any misrouting or non-delivery of signals, data information, messages or orders from you to other persons or from other persons to you, or any scrambling or distortion of data or information contained in them.

1.3.4 Any liability not excluded by this agreement shall, in respect of any one or more events, or series of events (whether connected or unconnected) taking place within any twelve month period be limited, in the case of defects falling within clause 9.3a to three times the price of the relevant goods/services. This limit shall also apply in the event that any exclusion or other provision contained in this agreement is held to be invalid for any reason and JMH Enterprises becomes liable for loss or damage that could otherwise have been limited.

1.4 You agree and acknowledge that you are in a better position than JMH Enterprises to foresee and evaluate any potential damage or loss that you may suffer in connection with the goods and services provided by JMH Enterprises and, therefore, that JMH Enterprises cannot adequately insure in respect of such liability. You warrant to JMH Enterprises that you will insure against, or bear yourself, any loss for which JMH Enterprises has excluded liability.

1.5 Some jurisdictions do not allow the exclusion of certain warranties or the limitation or exclusion of liability for incidental or consequential. Accordingly some of the limitations of liability set out in this clause 1 may not apply to you.

Unlawful Provision

If any provision of these Terms and Conditions shall be unlawful, void or for any reason, unenforceable then that provision shall be excluded and shall not affect the validity and enforceability of the remaining Terms and Conditions.

Governing Law and Jurisdiction

This contract is subject to the law of England and Wales. All disputes arising out of this contract shall be subject to the exclusive jurisdiction of the courts of England and Wales.

Those who access the site from other locations are responsible for compliance with their local laws and taxes as applicable.

Any disputes not resolved by normal complaints procedure shall be resolved exclusively in the courts of England and Wales under English law.
